The law is complex and ever changing. Family law is a fluid area of study that evolves over time. In the span of decades, we have seen the shift of public perception on social issues related to children and families and this in turn can impact the policies we create to protect and regulate familial relationships. There is a constant tension between government intervention and the right to privacy. Many of our laws pertaining to family balance these competing perspectives—when should the government intervene into the family relationship to protect individuals and children and when does the family have a right to privacy, free from government regulation? This fundamental question serves as the basis for many of the concepts discussed in this course.

Families in the Legal Environment is intended to provide the students with an overview of legal concepts that impact individuals, families, and children. This course follows the life span of individuals beginning with the idea of establishing parenthood. We will explore the concepts of paternity and adoption and consider what constitutes child abuse and neglect. We will spend a significant amount of time learning about marriage and divorce and considering the various factors that must be addressed when parents separate. The course concludes with chapters on disability planning and estate planning, two areas of law that impact end-of-life decision-making.

The content in this book is broad and conceptual and should not be intended as legal advice. Family laws often vary from state to state; so many of the concepts discussed in this book are based upon concepts in Colorado. Laws are regularly revised and updated so students should know that changes may occur and should do their own diligent research and consult with an attorney if they are seeking guidance on a personal legal matter and should not rely on the concepts in this book.

Families in the Legal Environment is a course that was originally developed by Celeste Kling, Esq. more than 20 years ago. Many of the concepts and examples discussed in this book are based upon the ideas and teachings of Ms. Kling. Without her, this course and book would not exist.
